1. Acceptance of Terms

By accessing or using HireMoko ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service. These Terms apply to all users, including visitors, customers, and contributors.

2. Description of Service

HireMoko is an AI-powered resume builder platform that helps users create, customize, and optimize resumes and cover letters for job applications. Our service includes:

• AI-powered resume customization based on job descriptions
• Resume templates and formatting tools
• Cover letter generation
• ATS (Applicant Tracking System) optimization features
• Resume storage and management

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account

3.2 Account Security

You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

4. Subscription and Payment

4.1 Free and Paid Plans

HireMoko offers both free and paid subscription plans. Features and limitations vary by plan. We reserve the right to modify, suspend, or discontinue any plan at any time.

4.2 Billing

For paid subscriptions:

• Subscriptions are billed in advance on a monthly or annual basis
• All fees are non-refundable except as required by law
• We reserve the right to change our pricing with 30 days' notice
• You authorize us to charge your payment method for all applicable fees

4.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will continue to have access to paid features until the end of your billing period.

5. User Content and Intellectual Property

5.1 Your Content

You retain ownership of all content you upload, create, or provide to the Service ("User Content"). By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your User Content solely to provide and improve the Service.

5.2 Our Content

The Service, including all software, designs, text, graphics, and other content, is owned by HireMoko or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

5.3 Prohibited Content

You agree not to upload, post, or transmit any content that is illegal, harmful, threatening, abusive, or violates any third-party rights. We reserve the right to remove any content that violates these Terms.

6. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to the Service or related systems
• Interfere with or disrupt the Service or servers
• Use automated systems (bots, scrapers) to access the Service without permission
• Reverse engineer, decompile, or disassemble any part of the Service
• Resell or redistribute the Service without authorization
• Impersonate any person or entity or misrepresent your affiliation

7. AI-Generated Content

Our Service uses artificial intelligence to generate and customize content. You acknowledge that:

• AI-generated content may contain errors or inaccuracies
• You are responsible for reviewing and verifying all AI-generated content
• We do not guarantee the accuracy, completeness, or suitability of AI-generated content
• You should not rely solely on AI-generated content without human review

8. Disclaimers and Limitations of Liability

8.1 Service Availability

The Service is provided "as is" and "as available." We do not guarantee that the Service will be uninterrupted, error-free, or secure. We may modify, suspend, or discontinue the Service at any time without notice.

8.2 No Guarantees

We do not guarantee that using HireMoko will result in job offers, interviews, or employment. Job search outcomes depend on numerous factors beyond our control.

8.3 Limitation of Liability

To the maximum extent permitted by law, HireMoko and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

9. Indemnification

You agree to indemnify and hold harmless HireMoko, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to your use of the Service, violation of these Terms, or infringement of any rights of another.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account and User Content
• All provisions of these Terms that by their nature should survive termination will survive

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Philippines, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the Philippines.
